This is Mario Media's legal information section. Since our servers are based in the US, we are bound by the laws of that country. We, to the best of our knowledge, have followed all the necessary laws which allow us to do what we do. However, if there are still matters which need to be discussed in a legal matter, please contact Philip 'GreenYoshi' Whitehall by emailing philip.whitehall@xiinet.com, the owner and founder of Mario Media. It is the visitor's sole responsibility to read our legal information before using any service that Mario Media provides. This page can also change occasionally, so it is important to keep checking if anything has been altered whether the homepage or other locations states the changes or not. Failure to do so means the visitor will be solely responsible for any legal consequence as outlined by the clauses below.

Clause 1: The Organisation
1A: 'Mario Media'(MM) was founded on 1st July 2006 as a project of 'Xiin Networks' (XiiNet), both of which are copyright © Philip 'GreenYoshi' Whitehall 2006 – 2010. Therefore, 'Mario Media' and all original designs, images & audio © Nintendo Co. Ltd. and in-house content are copyright © 'Xiin Networks' 2006 – 2013.
1B: 'Mario Media' is a non-profit, non-commercial organisation and as such is hosted purely with no direct or indirect profitable income. 'Mario Media' and/or 'Xiin Networks' do not charge visitors to use the website or any of its services.
1C: The purpose of this fan website is purely to promote and celebrate the existence of Nintendo, the Mario franchises and any other Nintendo-owned media, as well as the video games industry as a whole. No harm, copyright infringement or disrespect are intended by any content published on this website.
1D: Nintendo®, Super Mario™ and all other related characters, creations and trademarks are copyright © Nintendo. This organisation is in no way affiliated with Nintendo®, or is in any way represented by them (vice versa).

Clause 2: The Mario Media Website
2A: Any content or material originating from the 'Mario Media' or 'Xiin Networks' website starting with any variant of the URLs 'http://mariomedia.net', 'http://mariomedia.org', 'http://xiinet.com/media' or 'http://xiinet.com' is not to be modified or placed anywhere else on the Internet and/or World Wide Web without the expressed permission of Philip 'GreenYoshi' Whitehall of 'Mario Media' unless not originally owned by the organisation.
2B: 'Hot linking' to any content with from the 'Mario Media' website is prohibited, unless it has been pre-approved by Philip 'GreenYoshi' Whitehall. We only permit you to link to our web pages on other websites.
2C: The entirety of the 'Mario Media' basic website aspects uses the "NAX11" Content Mangement System (CMS) written in-house for websites across 'Xiin Networks' by Philip 'GreenYoshi' Whitehall.
2D: The 'Mario Media Boards' and 'Xiin Boards' are proudly powered by Invision Power Board, whereby 'Mario Media Boards' is a sub-forum of 'Xiin Networks'. We are covered under a perpetual (lifetime) license under the name of Philip Whitehall.

Clause 3: The Mario Media Browser
3A: The 'Mario Media Browser' refers to the large archive of Nintendo-owned and other video game media as well as member submitted files alongside Mario Media's in-house projects. The files available on the Mario Media Browser are made available for free and are there for educational and research purposes only, under, to the best of our understanding, Section 108 of Title 17 - Copyright Chapter 1, of the United Stated Code as effect from 3rd January 2007. For this reason, we prohibit bulk downloading in the form of zipped archives as it would be overstepping our legal stance.
3B: The Mario Media Browser is currently being powered by 'dirLIST - PHP Directory Lister' by Hamdiya under the terms of the GNU General Public License.

Clause 4: Privacy and Terms & Conditions
4A: All personal information collected and stored for use on the domains 'mariomedia.net', 'mariomedia.org' and 'xiinet.com' is held privately and is not distributed to anyone unless required by demand of the law. Compulsory information that's collected upon registration for a 'Xiin Network' account includes a username and email address. Any other optional information given to 'Mario Media' or 'Xiin Networks' is at the user's own risk, and will not be held responsible for their consequences.
4B: We do not automatically remove/delete accounts after an extensive period of inactivity, therefore if a user requires their account terminated, they must contact us via email as soon as possible.
4C: We view that having a 'Xiin Networks' member account is a privilege. If a member is found to be abusing or violating their account in any way whatsoever they will either be warned or banned from using the service as outlined by the Terms and Conditions stated on the 'Xiin Boards'.
